US Attorney General, the Attorney General, confirmed Habba's resignation on the start of the week. Bondi stated that the court's "flawed" ruling made it unworkable for the official to lead the department effectively.

Her resignation comes a week after a federal appellate panel ruled that she had been unlawfully serving as the top prosecutor. This judgment is expected to impact scores of legal proceedings in the Garden State.
The appellate judges ruled that a interim role that bypassed confirmation by the US Senate ran afoul of the Federal Vacancies Reform Act.

Bondi said that Habba will continue working within the DOJ as a senior adviser. Habba plans to seek further review of the ruling, aiming for a reversal.
On a social media platform, the Attorney General argued that the court "should not be able to countermand the appointment of lawyers tasked with carrying out the fundamental role of the presidency of enforcing the law."
