Czech 'Trumpist' Prime Minister-Elect Refuses to Divest Business Empire Amid Conflict-of-Interest Dispute

Andrej Babiš, the self-proclaimed tycoon that won the recent parliamentary vote, has declined to offload his extensive business interests, while insisting he will address a conflict of interest that might block him from taking the role of head of government.

Stance on Business Holdings

Babiš, whose ANO party came first in the October election but did not secure a majority in parliament, stated in a online statement that he would not sell his Agrofert conglomerate, which operates in farming, food processing, and chemical industries.

“I have consistently stated I will not sell Agrofert. I have repeatedly said I will resolve the ethical issue in compliance with Czech and EU regulations,” Babiš commented. “This is not like selling a roll in a bakeshop.”

President's Demand

The head of state, Petr Pavel, announced that the elderly populist must clarify openly how he will eliminate conflicts of interest arising from his business activities before being appointed prime minister.

The Czech constitution “clearly mandates the president to take into account the possible emergence of a ethical issue and the possibilities for its resolution” when appointing government ministers, Pavel's office explained.

The president “expects clarity in what precise manner Andrej Babiš will fulfil his constitutional and legal obligations”, the announcement said, stating that Pavel was prepared to designate Babiš as premier “immediately” once the issue was resolved.

Corporate Activities and Legal Issues

Babiš's numerous companies, primarily under the Agrofert umbrella, operate in the nation and other regional states, benefiting from millions of euros in domestic and European farming and other subsidies, as well as public contracts.

Under Czech law, cabinet members are barred from obtaining public aid or agreements. The ethics organization Transparency International has stated that to avoid a conflict of interest, Babiš must either divest, refuse public contracts, or stay out of government.

Previous Term and Present Intentions

Babiš said he would “abide by the regulations” if selected as prime minister, but did not want to explain how in beforehand because the issue was “an extremely sensitive and personal matter for me, and journalists will invariably criticise me regardless”.

During his initial tenure as prime minister, from 2017 to 2021, Babiš encountered multiple court cases and an EU investigation over possible conflicts of interest. He placed his assets into trust funds, while keeping certain control over them.

A judicial body and the European Commission both ruled that this was insufficient. Babiš confirmed last month that he was once more the exclusive proprietor of Agrofert and insisted he was “implementing measures” to avoid a conflict of interest, but refused to disclose details.

Governing Agreement and Foreign Policy Consequences

The billionaire populist has concluded a coalition agreement with two rightwing fringe parties, the ultra-conservative, pro-Russian SPD, which has advocated a public vote on leaving the EU, and the Motorists for Themselves, which has mainly campaigned against the EU’s environmental policy.

The incoming administration, if confirmed, is likely to bolster the populist movement in the region and might strain western support for Ukraine – even though Babiš has called Ukraine’s leader, Volodymyr Zelenskyy, to confirm of the nation's backing.

Pavel, who as president shares responsibility for foreign policy, also requested that the coalition’s programme add a statement on the official stance on Russia’s war in Ukraine, including a pledge to meeting alliance duties.

The head of state has previously stated he would not endorse any ministerial nominees who might doubt the nation's international alliances, a requirement that the far-right SPD has indicated it will meet by proposing independent technocrats.
